These Terms of Service ("Terms") govern your use of the website operated by SinCity Exclusives LLC ("SinCity Exclusives," "we," "us," or "our") and any reservation you make through it. Please read them carefully.

Acceptance of These Terms

By accessing or using our website, or by making a reservation, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use our website.

Our Website

Our website provides information about our rental vehicles and services and lets you make reservations online. Content on the website is for general information and may change without notice.

Your Rental Agreement

Every rental is subject to a separate rental agreement that you sign at booking or at pickup. The rental agreement contains the full terms of your rental, including fees, deposits, insurance, mileage, fuel, damage and return requirements. If anything in these Terms conflicts with your rental agreement, the rental agreement controls.

Eligibility

To rent a vehicle from us, you and every additional driver must:

• Meet the minimum age requirement shown on our Requirements page and in the rental agreement.
• Hold a valid, unexpired driver's license.
• Have active car insurance that meets the requirements shown on our Requirements page and in the rental agreement.
• Complete identity and license verification and provide accurate, complete information.

We may refuse or cancel any reservation if these requirements are not met, if verification cannot be completed, or if we reasonably believe a rental would create an unacceptable risk.

Reservations, Pricing, Deposits and Cancellations

Rates, fees, taxes, security deposits and add ons are shown during booking checkout and in your rental agreement. Prices may change until your reservation is confirmed, and a vehicle is not reserved for you until we confirm your booking. Cancellation, change, late return and no show policies are described at booking checkout and in your rental agreement, and those policies apply to your booking. If you need to change a reservation, contact us as early as possible. Changes depend on availability and may change your price.

Payment Authorization

When you make a reservation, you authorize us and our third party payment processor to charge your payment method for the rental price, taxes, fees and any security deposit or hold shown at checkout. You also authorize us to charge the same payment method for amounts you owe under the rental agreement, which may include tolls, tickets, fuel, cleaning, smoking fees, late returns, damage, loss and related administrative fees. Security deposits are released as described in the rental agreement.

Renter Responsibilities

During your rental, you agree that:

• No smoking or vaping is allowed in any vehicle.
• Vehicles may not be driven off road, on unpaved roads or on race tracks.
• Vehicles may not be used for racing, drifting, burnouts, speed contests, stunts or any other reckless driving.
• Only drivers who are approved and listed on the rental agreement may drive the vehicle. Unauthorized drivers are not allowed.
• You will obey all traffic laws and use the vehicle only for lawful purposes.
• You are responsible for all tolls, traffic tickets, parking citations, towing and impound fees, and similar charges incurred during your rental, plus any administrative fees stated in the rental agreement.
• You will return the vehicle on time and in the same condition you received it, with the fuel level required by the rental agreement.

Damage and Loss

You are responsible for damage to the vehicle and for loss of the vehicle, including theft, during your rental as provided in the rental agreement. This may include repair costs, loss of use, diminished value, towing, storage and administrative fees. Any protection products you purchase apply only as described in the rental agreement. Report any accident, damage, theft or mechanical problem to us right away, and to the police when required.

Vehicle Listings and Photos

We work to keep our vehicle descriptions, features, photos and prices accurate, but errors can happen. Photos are for illustration only, and the actual vehicle you receive may vary in color, trim, options, mileage or condition. If we cannot provide the vehicle you reserved, we may offer a similar vehicle or a refund of the amount you paid for that reservation.

Intellectual Property

Our website and its content, including text, photos, videos, logos, graphics and the SinCity Exclusives name, are owned by or licensed to SinCity Exclusives LLC and are protected by intellectual property laws. You may view and print pages from our website for your own personal use. You may not copy, reproduce, distribute, modify or use our content for any other purpose without our written permission.

Prohibited Uses of the Website

When using our website, you agree not to:

• Provide false or misleading information, use someone else's information, or make a booking without authorization.
• Use the website for any unlawful or fraudulent purpose.
• Interfere with or disrupt the website or the booking system, or try to gain unauthorized access to them or to related systems.
• Use bots, scrapers or other automated tools to collect content or data from the website.
• Upload viruses or other harmful code.
• Copy or misuse our content, trademarks or photos.

Third Party Links and Services

Our website uses and links to services operated by third parties, including the Valara booking system and our Instagram page (@sincity_exclusives). Your use of those services is subject to their own terms and privacy policies. We do not control and are not responsible for third party websites or services.

Disclaimers

Our website and its content are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and noninfringement. We do not guarantee that the website will be uninterrupted, secure or free of errors. Your vehicle rental is governed by the rental agreement.

Limitation of Liability

To the fullest extent permitted by law, SinCity Exclusives LLC and its owners, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or loss of use, arising from or related to your use of the website. Our total liability for any claim arising from or related to the website will not exceed the greater of the amount you paid us for the reservation that gave rise to the claim or one hundred dollars ($100). Liability relating to a rental is governed by the rental agreement. Some jurisdictions do not allow certain limits on liability, so some of these limits may not apply to you.

Indemnification

You agree to defend, indemnify and hold harmless SinCity Exclusives LLC and its owners, employees and agents from any claims, damages, losses, liabilities, costs and expenses, including reasonable attorneys' fees, arising from your use of the website or a rental vehicle, your violation of these Terms or the rental agreement, or your violation of any law or the rights of any third party.

Governing Law and Venue

These Terms are governed by the laws of the State of Nevada, without regard to its conflict of laws rules. Any dispute arising from or related to these Terms or our website must be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the jurisdiction of those courts.

Changes to These Terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page. Your continued use of the website after changes are posted means you accept the updated Terms.
